13 Mumbai policemen get life imprisonment in fake encounter case
மும்பை: ஜூலை 13, 2013: நிழல் உலக தாதா சோட்டா ராஜன் கூட்டாளி என்ற சந்தேகத்தின் பேரில், 7 வருடங்களுக்கு முன்னர் மும்பையில் நடந்த போலி என்கவுண்டர் தொடர்பிலான வழக்கு ஒன்றில், 13 போலீஸார் உள்ளிட்ட 21 பேருக்கு ஆயுள் தண்டனை அளித்து மும்பை செஷன் நீதிமன்றம் நேற்று பரபரப்பு தீர்ப்பு வழங்கியுள்ளது.
மும்பையை சேர்ந்த ராம் நாராயண் குப்தா என்பவர், மும்பை நிழல் உலக தாதா சோட்டா ராஜனுக்கு நெருக்கமானவர் எனக்கூறி 2006 இல் போலீசாரால் என்கவுண்டரில் சுட்டுக்கொல்லப்பட்டார். இதற்கு எதிராக அவரது சகோதரரும் வழக்கறிஞருமான ராம் பிரசாத் குப்தா மும்பை உயர் நீதிமன்றத்தில் வழக்கு தொடர்ந்தார். இதையடுத்து போலி என்கவுண்டரில் கொல்லப்பட்டதாக விசாரணை அறிக்கை தாக்கல் செய்யப்பட்டதால் இந்த வழக்கை விசாரிப்பதற்கு சிறப்பு புலனாய்வு குழு அமைக்கப்பட்டது. போலி என்கவுண்டரில் தொடர்புடைய பிரதீப் சர்மா மற்றும் 21 பேரை கடந்த 2010ம் ஆண்டு சிறப்பு புலனாய்வுக் குழு கைது செய்தது. நவி மும்பையை சேர்ந்த கட்டுமான நிறுவன அதிபர் ஜனார்த்தன் பாங்கே என்ற ஜன்யா ஷேத் என்பவருக்கும் ஷர்மாவுக்கும் நெருங்கிய தொடர்பு இருந்ததாகவும் அவர் கேட்டுக்கொண்டதன் பேரிலேயே ராம் நாராயண் போலி எண்கவுண்டரில் கொல்லப்பட்டதாகவும் விசாரணையில் தெரிவந்தது. இந்த வழக்கில் ஒரே சாட்சியாக விளங்கிய பேடா எனும் ராம் நாராயண் குப்தாவின் நண்பர், மர்மமான முறையில் உருக்குலைந்த நிலையில் சடலமாக மீட்கப்பட்டது மேலும் அதிர்ச்சியை ஏற்படுத்தியது. இந்நிலையிலேயே எண்கவுண்டருக்கு தலைமை வகித்த காவல் துறை முன்னாள் முதுநிலை ஆய்வாளர் பிரதீப் சூர்ய வன்சி, தனஜி சேதாய் மற்றும் திலிப் பலண்டே உள்ளிட்ட மூவர் மீதும் கொலைக் குற்றம் சுமத்தப்பட்டது. வழக்கு விசாரணையின் போது அரசு தரப்பு சாட்சியாக 110 பேரும், எதிர்தரப்பு சாட்சியாக 2 பேரும் சாட்சியம் அளித்தனர். இதையடுத்து சூழ்நிலை சான்றூகளின் அடிப்படையில் மட்டும் குற்றம் ச்சாட்டப்பட்டுள்ளதால் குற்றவாளிகளுக்கு மரணதண்டனை வழங்குவதை தவிர்க்க வேண்டும் என எதிர்தரப்பு வழக்கறிஞர் கேட்டுக்கொண்டார்.
இந்நிலையில் குற்றம் சாட்டப்பட்ட 13 போலீஸார் உள்ளிட்ட 21 பேருக்கும் மும்பை செஷன்ஸ் நீதிமன்றம் ஆயுள் தண்டனை விதித்தது. எனினும் இந்த வழக்கில் குற்றம் சாட்டப்பட்டு பணிநீக்கம் செய்யப்பட்ட போலிஸ் அதிகாரியும், என்கவுண்டர் நிபுணருமான பிரதீப் சர்மாவை நீதிமன்றம் வழக்கிலிருந்து விடுவித்துள்ளது. இவர் மீதான குற்றச்சாட்டுக்களுக்கு போதிய ஆதாரம் இல்லை என நீதிமன்றம் கூறியுள்ளது. இவர் 100க்கும் மேற்பட்ட குற்றவாளிகளை என்கவுண்டரில் வீழ்த்தி உள்ளாராம்.
English Summary: MUMBAI: Twenty one people, including 13 policemen, were sentenced to life imprisonment by a sessions court on Friday in connection with the 2006 fake encounter killing of Ram Narayan Gupta alias Lakhan Bhaiya, an alleged aide of fugitive gangster Chhota Rajan. In this fake encounter case the court had held 21 people guilty, while former encounter specialist Pradeep Sharma, who is credited with gunning down over 100 criminals, had been acquitted. Sessions judge VD Jadhvar sentenced all the accused to life imprisonment under various charges including murder, kidnapping and destruction of evidence. The court also imposed fine on them. As soon as the court hearing started, the judge said that accused No. 1 (Sharma) is acquitted of all charges and shall be released forthwith if he is not wanted in any other case. The court later began pronouncing the sentence. Senior inspector of police Pradeep Suryavanshi, who led the encounter team, was awarded life imprisonment on five different counts. Immediately after pronouncing the sentence, special public prosecutor Vidya Kasle told the court that some strict conditions should be imposed on Sharma. “As per the Bombay high court, the trial court has power to impose strict conditions on the acquitted person till the end of the appeal period,” she said. Kasle also told the court that the prosecution intends to file an appeal in the Bombay high court to challenge the acquittal. She also told the court that Sharma should not be allowed to leave the country and his passport should be impounded. At this, Sharma’s advocate informed the court that the former’s passport has expired and said that they did not have any objection to the rest of the conditions. The court later passed an order that Sharma will not leave the country without the permission of the court and he should furnish all the details regarding his passport with the prosecuting agency. The court also directed Sharma to file a bail bond of Rs 10,000.
