Tamil Nadu Governor Banwarilal Purohit reportedly telephoned Madras High Court Chief Justice Vijaya Kamlesh Tahilramani, expressing regret over the protocol lapse during the Chief Justice’s swearing-in ceremony at Raj Bhavan on Sunday. During the ceremony, High Court judges were made to sit behind the Ministers and police officers. This had led to a statement being issued by Justice M.S. Ramesh soon after the event, demanding an explanation from the officials. He wrote, “With a bit of dismay, I am constrained to bring on record the incautious protocol extended to the Judges of the MHC at today’s swearing-in ceremony by the organizers of Raj Bhavan. It was not only a disappointment but an issue of serious concern. Was the Raj Bhavan unaware of the hierarchy between the Constitutional dignitaries and the police officers? Or is it their understanding that the HC Judges rank below the order of Hon’ble Ministers and Police Officers? Being an official function, there cannot be a second opinion that the protocol to be extended was for the post and not the individual.” He had added that the Raj Bhavan officials not allowing the Registrar General of the High Court to inspect the seating arrangement before the event only fortified the suspicion that this was a “deliberate act of extending a cold shoulder” to the judges of the High Court. The Madras High Court Advocates Association (MHAA) had also condemned the “unceremonial and undignified manner” in which the seating arrangements were made, and had warned against a repetition of the incident. According to a report by The Hindu, the Governor now seems to have regretted the incident on a phone call with the Chief Justice. He also extended an invitation for the Independence Day at-home reception at the Raj Bhavan. This was then informed by Chief Justice Tahilramani to the High Court judges. She had further made it clear that she would be attending the reception, jointly hosted by him and the First Lady Pushpa Devi Purohit since the Governor had extended a personal invitation to her over phone. While the judges have been understood to have expressed satisfaction over the Governor has taken serious note of the issue, a few judges nevertheless skipped the reception.

நாமக்கல் மாவட்டம் ராசிபுரம் தாலுகாவில் உள்ள ஆக்கிரமிப்புகளை அகற்ற வேண்டும் என கோரிக்கை விடுத்து லோகநாதன் என்பவர் தொடர்ந்த ரிட் மனுவை விசாரித்த சென்னை உயர்நீதிமன்றம், ஆக்கிரமிப்புகளை அகற்ற உத்தரவு பிறப்பித்தது. எனினும் அந்த ஆக்கிரமிப்பு நிலங்களுக்கு பட்டா வழங்க கோரிய மனுக்கள் பரிசீலனையில் உள்ளதால் அந்த ஆக்கிரமிப்புகளை அகற்ற வேண்டாம் என்று நாமக்கல் மாவட்ட கலெக்டர் ஆசியா மரியம் உத்தரவு பிறப்பித்துள்ளதாக கூறி லோகநாதன் என்பவர் சென்னை உயர்நீதிமன்றத்தில் நீதிமன்ற அவமதிப்பு வழக்கு தொடுத்தார். இவ்வழக்கை விசாரித்த நீதியரசர் வேணுகோபால், மற்றும் நீதியரசர் வைத்தியநாதன் அடங்கிய அமர்வு, இவ்விவகாரத்தில் மாவட்ட கலைக்டர் மேல்முறையீட்டு அமைப்பை போன்று செயல்பட்டுள்ளதாக கடும் கண்டனம் தெரிவித்தார்கள்.

மேலும், அந்த ஆக்கிரமிப்புகளை உண்டானடிய அகற்ற வேண்டாம் என்றும் அவர் பிறப்பித்த உத்தரவை திரும்ப பெற மாவட்ட ஆட்சியருக்கு உத்தரவிட்ட நீதியரசர்கள், தவறினால் மார்ச் 4-ம் தேதி நேரில் ஆஜராக உத்தரவிட வேண்டும் என்றும் எச்சரித்தார்கள்.

Madras High court Condemns Namakkal collector for not obeying its order

Chennai: The Madras high court on Friday  slammed the Namakkal collector for enabling encroachers of a land to stay put despite a court order for their immediate eviction.

“This court is really shocked to see M Asya Mariam, the Namakkal district collector, pass order enabling the encroachments, despite a specific direction for removal of the encroachments by this court. This action of the District collector is highly condemnable and she must be taught about court proceedings as she is so smart enough to act as an appellate authority of this court,” a division bench of Justice M Venugopal and S Vaidyanathan said.

The bench made the observation on a contempt application filed by P Loganathan of Athanur village, Namakkal, praying to punish the officials manning the district administration  apparently for making a false statement with regard to the encroachments in the court.

“This contempt application has been mainly filed pursuant to an utterly and palpable incorrect statement made before this court by the special government pleader, who appeared for the Collector office authorities on March 1, 2018. Similarly, the proceedings of the District collector are absolutely nothing, but to disobey the orders of this court in its true letter and spirit,” the bench said.

Facing the slam from the court, the government advocate present in the court pleaded for time to initiate the collector to get back the proceedings on filing essential affidavit and to pass orders afresh after providing an opportunity of hearing to the petitioner and others.

Recording the submission, the bench permitted time till March 4 for the collector to get back her proceedings and file an affidavit before this court to follow that order. The bench made it clear that in the event of implement the said order, the collector shall appear before the court on March 4 and on her appearance, further orders will be passed, the bench added.
